With this Data Protection Statement we, Frey & Partner Zürich AG (hereinafter Frey & Partner, we or us), describe how we collect and further process personal data. The term “personal data” in this Data Protection Statement shall mean any information that identifies, or could reasonably be used, to identify any person. If you provide us with personal data of other persons (such as family members, work colleagues, etc.), please make sure the respective persons are aware of this Data Protection Statement and only provide us with their data if you are allowed to do so and such personal data is correct.

2. What personal data do we process?

We primarily process personal data that we obtain from (i) our clients and (ii) service providers as well as (iii) other individuals in the context of our business relationships with them or our clients or that we (iv) collect from users when operating our website.

Insofar as it is permitted to us, we obtain certain personal data from publicly accessible sources (e.g., debt registers, land registries, commercial registers) or we may receive such information from authorities or other third parties (such as e.g. banks). Apart from data you provided to us directly, the categories of data we receive about you from third parties include, but are not limited to, information from public registers, data received in connection with administrative or court proceedings, information in connection with your professional role and activities, information about you in correspondence and discussions with third parties, information about you given to us by individuals associated with you (family, consultants, legal representatives, etc.) in order to conclude or process contracts with you or with your involvement (e.g. references, your delivery-address, powers of attorney), information regarding legal regulations such as anti-money laundering and export restrictions, bank details, information regarding insurances, your address, data in connection with your use of our websites (e.g., date of your visit, type of web browser, your IP address, the operating system used and the domain name of your internet service provider).

3. For what purposes do we use your personal data?

We primarily use personal data in order to conclude and process contracts with our clients, business partners and service providers, in particular in connection with legal services to our clients as well as in order to comply with our domestic and foreign legal obligations. You may be affected by our data processing in your capacity as a client, person connected to a client, an employee of a client or a service provider or business partner.

Moreover, we use personal data of website visitors for administration purposes and to ensure the functionality of the website. This data is required in order to correctly deliver and optimize the contents of the website, to guarantee the long-term operability of the IT systems and of the website and to provide law enforcement authorities with the information they need for criminal prosecution in the event of a cyber-attack.

In addition, in line with applicable law and where appropriate, we may process your personal data and personal data of third parties for the following purposes, which are in our (or, as the case may be, any third parties’) legitimate interest, such as:

  • asserting legal claims and defense in legal disputes and official proceedings;
  • ensuring our operation, including our IT, our websites.

If you have given us your consent to process your personal data for certain purposes, we will process your personal data within the scope of and based on this consent, unless we have another legal basis, provided that we require one. Consent given can be withdrawn at any time, but this does not affect data processed prior to withdrawal.

4. Who may receive my personal data and where are the recipients located?

In the context of our business activities and in line with the purposes of the data processing, we may transfer data to third parties, insofar as such a transfer is permitted and we deem it appropriate, in order for them to process data for us or, as the case may be, their own purposes. In particular, the following categories of recipients may be concerned who may receive the personal data as controllers or processors depending on the circumstances: 

  • our service providers (e.g. banks or IT providers; in particular IT providers who support our business activities with software as a service);
  • subcontractors and other business partners;
  • domestic and foreign authorities or courts;
  • other parties in possible or pending legal proceedings;

Normally all our Recipients are located in Switzerland. In exceptional cases Recipients are located in any country worldwide. This is e.g. the case if you ask us to apply for a permit with a foreign authority.

If a Recipient is located in a country without adequate statutory data protection, we make sure that the legal requirements in the Swiss data protection act for such a transfer are observed.

5. Amendments of this Data Protection Statement

We may amend this Data Protection Statement at any time without prior notice. The current version published on our website shall apply. If the Data Protection Statement is part of an agreement with you, we will notify you by e-mail or other appropriate means in case of crucial amendments.
